By creating an account or using Homis, you agree to these Terms of Use.

If you do not agree, do not use the App.

2. Description of Service

Homis is a residential community platform that enables:

• Community messaging
• Buying/selling goods
• Offering services
• Event management
• Poll creation and voting
• Vendor promotions
• Special discounts

Homis acts as a platform, not a party to transactions between users.

3. Eligibility

You must:

• Be at least 18 years old
• Provide accurate information
• Be a legitimate resident or authorized member of a community

Homis may suspend accounts that violate this.

4. User Responsibilities

You agree NOT to:

• Post illegal content
• Harass other users
• Impersonate others
• Sell prohibited items
• Circumvent fees
• Use bots or automated scraping

You are solely responsible for your interactions.

5. Marketplace Disclaimer

Homis:

• Does not guarantee quality of goods/services
• Is not responsible for disputes between users

Transactions are at your own risk.

6. Vendor Offers

Vendors may:

• Offer promotions
• Pay listing or advertising fees
• Offer discount codes

Homis is not responsible for vendor fulfillment quality.

7. Payments & Fees

Homis may charge:

• Vendor listing fees
• Subscription fees
• Platform fees
• Transaction fees

Fees are non-refundable unless required by law.

8. Content Ownership

You retain ownership of content you post.

By posting content, you grant Homis a non-exclusive, worldwide, royalty-free license to:

• Display
• Distribute
• Promote within the platform

9. Account Termination

Homis may suspend or terminate accounts for:

• Violating terms
• Fraudulent behavior
• Harassment
• Illegal activity

You may delete your account at any time.

10. Limitation of Liability

To the maximum extent permitted by law, Homis Inc. shall not be liable for:

• User disputes
• Lost profits
• Fraud by other users
• Indirect or consequential damages

Use of the platform is at your own risk.

11. Indemnification

You agree to indemnify Homis Inc. against claims resulting from:

• Your use of the platform
• Your content
• Your transactions

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States.

13. Arbitration Clause

Disputes shall be resolved by binding arbitration in the State of Delaware, except where prohibited by law.

14. Changes to Terms

We may update these Terms. Continued use means acceptance.

Marketplace Rules

Welcome to the Homis Marketplace. This section is designed for residents to buy, sell, and offer personal goods and services within their community. By creating a listing, you agree to follow the rules below.

1. Personal Items & Services Only

The Marketplace is intended for:

• Personal goods that you legally own
• Services you personally provide
• Small-scale local offers between residents

This is not a commercial e-commerce platform. You may not:

• Operate a large retail business
• List bulk inventory for resale
• Post commercial advertisements unrelated to the community
• Use the Marketplace as a storefront for outside businesses without approval

2. Ownership Requirement

You may only list items that:

• You personally own
• You have legal rights to sell
• Are currently in your possession

You may not:

• Sell items that belong to someone else
• Sell stolen goods
• Sell items you do not physically own
• Act as a broker or middleman without ownership

If requested, you must be able to prove ownership.

3. No Dropshipping or Third-Party Fulfillment

Listings must represent items or services directly controlled by you. You may not:

• Dropship products
• List items from Amazon, AliExpress, or other marketplaces
• Resell items you do not possess
• Use third-party fulfillment companies
• Misrepresent product origin or availability

Homis Marketplace is built for trust between neighbors — not anonymous online reselling.

4. Prohibited Items & Services

The following are strictly prohibited:

Illegal or Regulated Items

• Drugs, narcotics, controlled substances
• Drug paraphernalia
• Prescription medications
• Weapons (firearms, ammunition, explosives)
• Stolen property
• Counterfeit goods
• Fake documents or IDs

Restricted Content

• Adult content or services
• Escort services
• Gambling-related services
• Pyramid schemes or MLM recruitment
• Cryptocurrency scams or "investment opportunities"
• Get-rich-quick schemes

Unsafe or Harmful Items

• Hazardous chemicals
• Toxic materials
• Recalled or unsafe products
• Items that violate federal, state, or local law

If it is illegal, dangerous, or deceptive — it does not belong on Homis.

5. No Scams or Fraudulent Activity

Users may not:

• Misrepresent an item's condition
• Use fake photos
• Post misleading descriptions
• Collect payment without intent to deliver
• Impersonate another person
• Use phishing tactics
• Attempt payment fraud
• Ask for off-platform payments in suspicious ways

Any attempt to scam will result in immediate account suspension.

6. Accurate Listings Required

All listings must include:

• Clear and recent photos
• Honest description
• Real condition of the item
• Fair and transparent pricing

Spam, duplicate listings, or misleading posts may be removed.

7. Local Transactions Only

Marketplace transactions are intended for:

• Local exchanges within the community
• In-person or clearly agreed-upon arrangements

Homis is not responsible for disputes between users, but we may investigate reports of abuse or fraud.

8. Respect Community Standards

All interactions must remain:

• Respectful
• Professional
• Non-discriminatory

Harassment, threats, or inappropriate messages may lead to removal from the platform.

9. Enforcement

Homis reserves the right to:

• Remove any listing at any time
• Suspend or ban accounts
• Report illegal activity to authorities

Violation of these rules may result in permanent removal from the app.
